While I hope that, if plaintiffs prove their case, the jury finds Instagram liable for these alleged violations of law and will render an award of damages of such an amount that it will deter any such future violations by Instagram and others, there are at least two other corporate persons, whose rules have been violated and who should, therefore, act to punish Instagram, if these allegations are true. That would be Apple, Inc. and Google, Inc.

What Instagram is alleged to have done violates the privacy policies and terms of service of both those companies for their respective mobile operating systems, Apple's iOS and Google's Android. So will Apple and Google investigate Instagram's alleged misconduct and, if they find that the allegations against Instagram are true, remove Instagram's app from their respective application stores?
